Some issues of preliminary hearing in summary investigation

Summary investigation is a differentiated procedure, which is regulated in Chapter XXVII (Art. 370–374) of the Criminal Procedure Code (CPC). In order for the summary proceeding to be applied, „preliminary hearing of the parties“ is provided for. The regulation of an open session ruling turns the procedure of „preliminary hearing of the parties“ into a pointless one. The existence of the provision of Art. 252, para. 1 CPC is needless as well.
