The criminal loss of documents, publications or materials containing information representing a state secret or foreign classified information under Act. 358 of the Criminal Code

Abstract

The present study analyzes the legal norms under art. 358, paragraph 1 and paragraph 2 of the Criminal code, which regulate the criminal loss of documents, publications and materials containing information representing a state secret or foreign classified information received under an international treaty to which the Republic of Bulgaria is a party. All the signs of this crime are critically examined. The main purpose of the study is to contribute to the correct interpretation and lawful application of the norms under art. 358, paragraph 1 and paragraph 2 of the Criminal code. Proposals have been made to improve the composition of the crime under art. 358, paragraph 1 of the Criminal code. A comparative analysis of this crime with other crimes was carried out.
