Violations of jurisdiction in relation to the cases, the functional and the special jurisdiction as grounds of cassation in the bulgarian criminal proceedings

Abstract

The article examines the jurisdiction of criminal proceedings „in relation to the cases“, the functional jurisdiction and the special jurisdiction of the military courts. The opinion is substantiated when the violation of these three types of jurisdiction is considered a manifestation of the cassation grounds for an illegal court composition, and proposals have been made to improve the legislation.
