Practical issues in determining the liability for costs in administrative sanction proceedings

Abstract

The publication aims to summarize the practical problems in determining liability for costs in administrative criminal cases. The problems are predicated by the fact that judicial review begins before the general courts and ends before the administrative courts. It is allowed to mix different procedures – criminal and administrative proceedings. In addition, the Law on Administrative Offenses and Penalties and the Administrative Procedure Code do not provide for liability for costs in case of partial cancellation or amendment of the contested act.
