On the need for further development of corporate responsibility for crimes in Bulgaria

Abstract

The effective counteraction to corporate crime is of extreme importance for any jurisdiction under the conditions of an increasing number of crimes committed with the participation of legal entities. Bulgaria has introduced administrative and criminal law responsibility for the criminal activity of those legal entities which have benefited from such. Unfortunately, the regulation re- mains poorly developed. The article gives a comparative analysis of the regulation of corporate responsibility for crimes in our country and in several other EU Member States. The study shows that, in spite of all the differences, the legislation of Italy, Slovenia and Rumania have a common feature - they are well developed and give a detailed regulation of substantive and procedural law aspects of the responsibility of legal entities. The conclusion contains proposals for further development of the operating regulation in Bulgaria.
