The Bulgarian penal law and the significance of social danger in the process of its application

This paper explores the role of the social danger requirement in the legal definition of crime. It is argued that such a requirement is not necessary. The provision on the insignificant act is sufficient to distinguish between criminal and noncriminal activities. Besides, justifications for crimes shall not be described as characteristics of non-socially dangerous acts only. The law must give an appropriate legal evaluation of these acts.
